Wong Xiao Wei is a Senior Associate at RCLT Law.

Over the years in practice, Xiao Wei has built a broad civil litigation and international arbitration practice, with particular depth in complex cross-border arbitration, civil and commercial fraud litigation, and criminal litigation. This work has spanned disputes involving allegations of fraud and conspiracy, breach of fiduciary duty, professional negligence, and trust and estate matters.

She also maintains an active criminal defence and legal aid practice, acting as counsel under the Criminal Legal Aid Scheme (CLAS) and as assisting counsel under LASCO in matters involving charges under the Penal Code, the Misuse of Drugs Act, and other offences.

  • Advises clients in SIAC, LMAA and HKMAG arbitrations concerning charterparty, and sale and purchase disputes.
  • Assisted a shipowner in securing the release of a vessel involved in a collision on the Yangtze River, first through a successful forum non conveniens application in Singapore, and later by furnishing appropriate security after the vessel was re-arrested in Australia.
  • Assisted a commodities trading client in enforcing an SIAC arbitration award against a mine-owner in Indonesia. Acted in a High Court trial and a connected Korean Arbitration concerning the breach of several contracts for the sale of coal between an Indonesian coal supplier and a Korean company, and contested a related winding-up application brought against the client.
  • Assisted in a London Arbitration concerning the failure to supply and load paraxylene cargo at the port of New Mangalore, India, arguing that the failure was caused by COVID-19 lockdown measures imposed by the Indian authorities.
  • Assisted the ship managers of a vessel alleged to have damaged a submarine cable belonging to a Maltese company, in connection with proceedings commenced in the Maltese courts and a limitation fund established in Singapore.
  • Assisted in a London Arbitration involving multiple parties in a charterparty chain concerning damage to cargo shipped onboard a vessel, including an application to strike out the claim for want of prosecution.
  • Acted as instructed solicitor in the Hin Leong Trading and Ocean Tankers Pte Ltd litigation, including four interpleader proceedings concerning title to cargo onboard four vessels and related civil suits alleging fraud and conspiracy against the company’s directors.
  • Acted for a minority shareholder in a High Court suit against the majority shareholders of a joint venture company, obtaining an injunction restraining an EGM from proceeding with a resolution on the joint venture.
  • Assisted in a suit involving allegations of fraud, misrepresentation and breach of fiduciary duty against a company’s former legal consultant.
  • Acted in a contractual claim against a Japanese multinational information technology and electronics corporation, involving complex issues of attribution of knowledge and conspiracy.
  • Obtained and executed an Anton Piller search order against former employees of an international operations management consulting corporation.
  • Acted for a Kenyan client in a claim against a Hong Kong cryptocurrency company and an escrow agent for fraud and deceit.
  • Instructed by professional insurers to act for Rajah & Tann Singapore LLP in a suit brought against the firm by former clients for a claim in conflict of interest and breach of confidence: reported in Ocean Tankers (Pte) Ltd (under judicial management) v Rajah & Tann Singapore LLP and another matter [2021] SGHC 144 and Lim Oon Kuin and others v Rajah & Tann Singapore LLP and another appeal [2022] SGCA 29.
  • Assisted a deceased’s daughter in obtaining an unperfected gift of USD1.5 million: reported in WDS v WDT [2022] SGHCF 12 and WDT v WDS [2023] SGHC(A) 7.
  • Acted as counsel under the Criminal Legal Aid Scheme (CLAS) and as assisting counsel under the Law Society’s LASCO scheme in matters concerning charges under the Penal Code, Misuse of Drugs Act, the Miscellaneous Offences (Public Order and Nuisance) Act, and other offences.
  • Assisted in CLAS matters involving charges of theft, shoplifting, causing grievous hurt, and affray.
